The question as to whether a dominant firm may abuse its market power in violation of EU competition law by granting more favorable treatment to its own products or services than to those of its competitors is a topic of lively discussion. After the decision rendered by the European Commission in 2017, validated by the General Court in 2021, an appeal is currently pending before the Court of Justice of the EU.
