The Treaty of Lisbon abolished the Pillar structure and brought the Common Foreign and Security Policy (CFSP) within the constitutional framework of the Treaties. The CFSP requires navigating a tension: upholding the constitutional guarantees of the Union legal order while respecting the field’s intergovernmental and highly political nature – which largely excludes the Court’s jurisdiction. In the past decade, the Court has opted an expansive interpretation of its jurisdiction in CFSP, steadily filling up gaps in judicial protection. How can judicial review in the CFSP reach its full potential and where will and should the Court draw the limits of its jurisdiction?

Join us for a discussion with Dr. Antonios Antoniadis (Legal service of the Council), Advocate General Tamara ?apeta (Court of Justice of the EU), and Prof. Peter Van Elsuwege (Ghent University) who will tackle the constitutional, institutional and wider political perspectives of the question of judicial review in CFSP.
